A company cannot apply for its own security clearance. Rather the government procuring activity or (in the case of a subcontractor) the cleared contractor can start the process on the facility's behalf.

Generally speaking, for a company to be cleared it must be owned and controlled by U.S. citizens who are themselves cleared individuals. In some rare cases, involving joint foreign and domestic ownership, firewall systems that keep uncleared owners away from secret information have proven acceptable.

For a brief primer on facilities security clearances, we recommend review of the Defense Security Service's Facilities Clearance Checklist. Companies interested in being facility-cleared may also find the Defense Security Service's list of frequently asked questions about the facility clearance process to be helpful.

Our security clearance attorneys, who are experienced in business restructuring, also assist companies that have concerns about how restructurings, ownership changes or personnel changes may affect their company security status. We have helped companies develop and implement security protocols and systems and have audited security practices to assure proper compliance with governing directives.
